政策工具视角下的新业态劳动者权益保障政策研究——以《关于维护新就业形态劳动者劳动保障权益的指导意见》为例

摘要: 新型就业形态的特殊性给劳动者权益保障带来诸多困难,亟须政策予以引导和规范。本文以公共政策工具为视角,以《关于维护新就业形态劳动者劳动保障权益的指导意见》文本为例,运用内容分析法对新业态劳动者权益保障政策文本进行编码分类,并建立政策工具和劳动权益保障内容的二维分析框架进行分析。从分析结果可以看出,相关政策工具具有多样性特点,且内部结构差异明显,劳动权益保障内容全面且重点突出。这是政府基于现实问题和现行条件对有关问题进行积极回应的表现,但也存在政策工具整体配置不均衡等问题。总体而言,相关政策具有强指向性,但是仍处于“补短”阶段。未来新业态劳动者权益保障政策的发展, 应综合考虑新业态劳动者的权益内容, 充分发挥不同政策工具的价值, 适时调整政策工具的结构, 优化政策工具配置。

Abstract: The particularity of new employment forms has brought many difficulties to the protection of workers’ rights and interests, which urgently needs policy guidance and standardization. From the perspective of public policy tools and taking the text of the Guiding Opinions on Protection of Rights and Interests of Workers in New Employment Forms as an example, this paper uses the content analysis method to code and classify the texts of the policies on protection of rights and interests of workers in new employment forms, and establishes a two-dimensional analysis framework of policy tools and the content of protection of rights and interests of workers for analysis. From the analysis results, it can be seen that the relevant policy tools have the characteristics of diversity, the internal structure difference is obvious, and the content of protection of rights and interests of workers is comprehensive and focused. This is a manifestation of the government’s positive response to relevant problems based on practical problems and current conditions, but there are also problems such as unbalanced overall configuration of policy tools. Generally speaking, the relevant policies have strong directivity, but they are still in the stage of “making up for deficiencies”. In the future, the development of policies on protection of rights and interests of workers in new employment forms should comprehensively consider the rights and interests of workers in new employment forms, give full play to the value of different policy tools, adjust the structure of policy tools in time and optimize the configuration of policy tools.
